Terms of Service

This is a working draft, not final legal text. It's written to be accurate about what the product actually does, but it has not been reviewed by counsel. Get it reviewed before relying on it for a real signup or billing relationship at scale.

1. What VibeHard is

VibeHard is a software factory with an inspection line. You describe an application; VibeHard drafts a specification, generates code against it, and runs a fixed sequence of automated checks ("gates") before the application is deployed. A build that fails a gate does not ship. Findings the automated fix loop can't resolve hold the build; a held build does not deploy.

2. What VibeHard does not claim

Passing the gate line means a build met the specific, deterministic checks each gate runs — nothing more. VibeHard does not claim that any generated application is "HIPAA-compliant," "SOC 2 certified," or compliant with any other regulatory framework. Compliance with a legal or regulatory standard is a determination only you and your counsel can make about your specific use. Gate output can inform that determination; it is not a substitute for it.

3. Accounts and plans

You need an account, authenticated via Google or email/password, to build or deploy an application. Plans (Free, Starter, Pro) set daily build throughput and project limits; current figures are published on the pricing page and may change with notice. Every plan runs the identical gate line — plan tier never affects how carefully a build is checked.

4. Your data and your generated application

Each application you build gets its own dedicated database project. VibeHard provisions and manages this by default under its own infrastructure account, so there's nothing for you to separately set up — but it means VibeHard's platform, not you personally, holds the operational credentials needed to run migrations, deploys, and gate checks against it. Your application's data is never stored in a table shared with another customer's application.

You own the code and the application that VibeHard generates for you, subject to these terms. You are responsible for how your generated application handles the data of its own end users (your clients, patients, or customers) — VibeHard's gates check for common leak patterns and missing controls, but you remain the operator of your application and the party responsible for its lawful use.

5. Acceptable use

You may not use VibeHard to build applications intended to violate law, to knowingly circumvent the security gates, or to attempt to access another customer's application or data. Attempting to defeat the isolation between applications is a violation of these terms regardless of whether the attempt succeeds.

6. Held builds

When a gate flags something the automated fix loop cannot resolve, your build is held. Held builds do not deploy until the findings are resolved — by re-running the fix loop or by revising your request. This applies at every plan tier.

7. Service availability and changes

VibeHard is provided on an as-available basis. Features, gate behavior, and pricing may change; material changes to pricing or plan limits will be communicated in advance where practical. VibeHard is not liable for downtime, data loss, or business interruption beyond what applicable law requires.

8. Termination

You may stop using VibeHard and close your account at any time. VibeHard may suspend or terminate accounts that violate these terms, including attempts to bypass the gate line or access other customers' data.

9. Limitation of liability

VibeHard's gates reduce, but cannot eliminate, the risk of defects or security issues in generated software. To the maximum extent permitted by law, VibeHard is not liable for indirect, incidental, or consequential damages arising from use of the service or of any application it generates.
